ISLAMABAD: President Asif Ali Zardari on Saturday promulgated the Sacked Employees (Reinstatement) Ordinance 2009 to reinstate the over 7,000 people who were appointed in corporation services; autonomous; or semi-autonomous bodies or government service during the period between November 1, 1993 and November 30, 1996 and were sacked between November 1, 1996 and December 31, 1998.

Under the ordinance, all such employees would be reinstated immediately on a scale one pay-grade higher than the substantive scale of their post at the time of termination. If any post was changed by the competent authority after December 1998, the reinstatement will be one scale higher than the revised or existing scale or the post. Upon reinstatement, each employee would be paid compensation equal to three years’ emoluments of the pay scale in which he would be placed in three yearly instalments.

The employees who were given forced ‘golden handshake’ during this period shall also be reinstated subject to reimbursement of all monetary benefits received.

The employees in corporation or government service who held contract posts against a regular post and whose contract was extended at least once before dismissal shall also be reinstated immediately and adjusted against regular post. Contract employees working against a temporary post at the time of termination would be reinstated for the remaining portion of the contract.

The persons who were dismissed, removed or terminated from service on account of closure of organisation; or absence from duty; misappropriation of government money; or medical unfitness can now file petitions before a review board composed of secretaries of law and justice and establishment divisions and a retired judge of the supreme or high court for decision within 30 days.
