The affected people of CDA’s I-15 sector have demanded of the CDA to implement the federal ombudsman’s judgment by October 19.

In August, the Federal Ombudsman had directed the Capital Development Authority (CDA) for application of unified refund policy for the allotees of plots and flats in Sector I-15, Islamabad according to the cited copy of the judgment here Thursday.

The allotees of the plots and flats in Sector I-15 two years ago have appealed to the CDA chairman to do the needful to mitigate their sufferings.

Federal Ombudsman’s August 19, 2008 consensus judgment envisages the deduction of Rs5000 only instead of deduction of 10 percent from the allotees.

The Human Rights Society of Pakistan (HRSP) had approached the Federal Ombudsman, for a ruling on CDA unjust and unfair refund policy for Sector I-15 allotees.

The Advisor, WM Secretariat Syed Yasin Ahmed in a consensus judgment had directed CDA to take necessary steps within two months.

The CDA representative while recording his statement said that new refund policy, approved in February 2008, cannot apply with retrospective effect.

The CDA had approved new refund policy for I-15 Sector in February 2008, which envisages deduction of Rs5,000 and refund of the remaining amount to the allotees of the flat or plot in Sector I-15, Islamabad.

However, the same has not been applied with retrospective effect and those who were refunded after deduction of 10 per cent, prior to the approval of the policy have been ignored.

The federal ombudsman in his judgment said that those who were given offers of plots or flats only and not the allotment letters were also entitled to get the benefit of February 2008 refund policy.

The CDA should move another summary to the Board of Director within two months i.e. by October 19, 2008 to include all those who got refund prior to the approval of February 8, 2008 summary in this regard, according to the judgment.
