A local Court will take up Evacuee Trust Property Board (ETPB) case regarding the non-transparent allotment of Board flats in Rawalpindi here next week. Earlier this month, the Prime Minister ordered an inquiry against the Chairman, ETPB Asif Hashmi following receipt of complaints against him. The court will decide about the jurisdiction of the court to adjudicate the ETPB case on November 28. The Defendants challenged the jurisdiction of the court and the Plaintiff submitted a reply on the last date of hearing.
The Counsel for the Plaintiff, Chaudhry Sarfraz Warriach, Advocate argued that ETPB invited applications for giving flats on rent through the national press. But, while demanding Rs.1, 00,000. Call Deposit, it advertised in less important papers through addendum only. The same addendum was not given in the national papers which also carried the first advertisement. Instead of contacting the applicants by registered post, the ETPB deliberately tried to conceal the addendum, which was malafide and unfair under the law. The Executive Engineer ETPB, Lahore appeared in the court on behalf of the ETPB, Lahore.
The ETPB invited applications in February and May 2009. It prayed that the process of allotment should be stayed till the judgment of the present case.
