ISLAMABAD - The Islamabad High Court (IHC) Wednesday directed the Capital Development Authority (CDA) to prepare a list of residential plots being used for commercial use in the capital.
Justice Shaukat Aziz Siddiqui directed the CDA to submit this list before the court and deferred the hearing.
The judge issued these directions while hearing the petition of Syed Asadullah Kazmi.
The petitioner cited Capital Development Authority (CDA) and Samina Bano Rehman, a resident of G-6/3, as respondents.
The petitioner told the court that Samina Bano Rehman is residing in his neighbourhood and she is illegally and in contravention to the CDA bylaws carrying out commercial activities at her residence.
He further added that the respondent is on the verge of opening a franchise of a UK-based multi national commercial unisex saloon, mixed massage centre for ladies and gents and joint sauna bath namely "Toni & Guy" at her house in G-6/3.
Petitioner maintained that not only the contemplated commercial activity in the residential area is against the law, rules, regulations and CDA byelaws but also repugnant to the moral as well as Islamic ordains and contours of the locality.
"The massage centre and mix sauna bath facilities for ladies and gents in the guise of saloon in a residential area shall have very negative impact on the residents of the quite neighbourhood in general and its youth in particular," he maintained.
He continued that these commercial activities, being deliberately overlooked rather clandestinely allowed by the CDA in consideration of greasing palms.
Therefore, he prayed before the court that it may direct the CDA to stop this contemplated activity.
