LAHORE - Justice Mansoor Ali Shah of the Lahore High Court on Monday ordered LDA to allot within 15 days two commercial plots in Township Housing Scheme to the petitioner who had paid 20 per cent amount of their bid money in an auction held by LDA in 2009.
The similar order was passed by Lahore High Court on 24 August 2010 against which later DG LDA filed appeal against on 18 February 2011. The court dismissed the LDA’s appeal and upheld its previous order in favour of the petitioner, directing again LDA to allot the plots to the petitioner within 14 days.
The court passed this order on the petition filed by Muhammad Hayat who pleaded that he participated in auction LDA held on July 15, 2009 and being highest bidder he was asked to deposit 20 per cent of the bid amount which he did however the plots have not been allotted in his name by LDA authorities till now. The LHC issued notice to LDA on January 21 2010 on which date LDA admitted that petitioner was the highest bidder at the auction and he also deposited 20 per cent of the bid amount. LDA lawyer also went on to say that plots were not transferred in name of petitioner because LDA had cancelled bid of the petitioner on 23 April 2009 on the ground that the amount of bid had to be more than the bid received in previous auctions. Later despite many reminders and notices from the court the LDA’s lawyer did not appear in the court for arguments on the matter and court had to conduct ex-party proceedings.
