Take Bani Gala land back from Bukhari, SC tells CDA

ISLAMABAD: The Supreme Court (SC) on Tuesday directed Capital Development Authority (CDA) to retrieve the 80 Kanal land of Bani Galla from Leader of the House in Senate Nayar Bukhari and his relatives within three days.

A three members bench of the apex court, headed by Chief Justice of Pakistan Iftikhar Muhammad Chaudhry took suo motu notice over the letter, written by Pakistan Tehreek-e-Ik Insaf Chairman Imran Khan against the illegal occupation of state’s land by Bukhari and his relatives.

During the course of proceedings, Bukhari appeared before the court and rejected that he had not occupied the state’s land.

He said some people were defaming him on political bases. The court informed him that CDA Chairman Imtiaz Inayat Elahi admitted during the chamber’s meeting that he and his relatives had occupied the state’s land.

Bukhari alleged that Imran Khan had occupied the CDA’s land illegally. Justice Khalilur Rehman Ramday observed: “you are elected Member of Parliament, therefore it is your duty to stop the illegal construction on CDA’s land”. CDA chairman also rejected some contents of Imran Khan’s letter, which he wrote to the CJP. Chief Justice also asked Elahi why you had not retrieved the land from occupants.

To this Elahi replied that there were some technical problems, as the land was purchased in mid 60s but local persons did not leave this land. He further told the court that the issue of ‘Shamlat’ was yet to be resolved.

The court expressed annoyance over the CDA chairman for not retrieving the state’s land by occupants and observed: “This is a simple issue but you (CDA chairman) are creating complexities. Why you are creating favorable situation for few influentials”. Justice Ramday asked the chairman it was his negligence on his part that why “he had spared valuable land for occupation”.

The court adjourned the hearing till January 14. Imran Khan wrote in his letter that with connivance of CDA officials, Bukhari and his relatives had occupied the civic body’s land. “I talked to CDA chairman but he was afraid of Bokhari,” Khan mentioned in his letter.
